By accessing or using the website at lascrucesinsulation.com (the "Site"), or by engaging Las Cruces Insulation ("we," "us," or "our") to perform services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, do not use this Site or engage our services.
These terms apply to all visitors, customers, and others who access or use the Site.
Las Cruces Insulation provides residential and commercial insulation services including, but not limited to, spray foam insulation, attic insulation, blown-in insulation, crawl space insulation, wall insulation, air sealing, vapor barrier installation, and insulation removal, primarily serving communities in southern New Mexico and west Texas.
Services are provided only upon execution of a written service agreement or acceptance of a written estimate. Nothing on this Site constitutes an offer to perform services or a binding agreement. All work is subject to an on-site assessment and a separate written estimate.
All estimates provided by Las Cruces Insulation are based on conditions observed during an on-site assessment and are valid for 30 days from the date of issuance unless otherwise stated in writing. Estimates are not binding until a written service agreement is signed by both parties.
Prices may change if conditions discovered during the work differ materially from those observed during the estimate, such as the presence of undisclosed damage, hazardous materials, or access conditions that require additional labor or materials. We will notify you before proceeding with work that would result in a price change above the original estimate.
Once a service date is agreed upon in writing, we reserve that time in our schedule for your project. If you need to cancel or reschedule, please notify us at least 48 hours in advance by phone or email.
Cancellations with less than 48 hours notice may result in a cancellation fee to cover scheduling and mobilization costs. The specific fee, if any, will be outlined in your service agreement. We reserve the right to reschedule appointments due to weather conditions, equipment issues, or other circumstances outside our control, and will notify you as early as possible if that becomes necessary.
Payment terms are specified in each individual service agreement. In general, payment is due upon completion of the work unless a deposit or payment schedule has been agreed upon in writing in advance. We accept cash, check, and electronic payment methods as listed in your service agreement.
Invoices not paid within the terms stated in your service agreement may be subject to a late fee. If an account remains unpaid and collection efforts become necessary, the customer may be responsible for reasonable collection costs, including attorney fees, to the extent permitted by applicable law.
You agree to provide accurate information about your property when requesting services or completing forms on this Site. You are responsible for ensuring that the work area is accessible on the scheduled date, including removing personal items from attics, crawl spaces, or other areas to be serviced. Failure to prepare the work area as directed may result in rescheduling and additional fees.
For spray foam installations and similar projects requiring vacating the premises, you are responsible for making alternative arrangements for yourself, your household members, and any pets for the duration of the work and the curing period specified by the contractor.
We stand behind our workmanship. Any specific warranty terms applicable to your project will be outlined in your written service agreement. Workmanship warranties cover defects in installation and do not cover damage caused by events outside our control, including water intrusion from pre-existing conditions, pest activity, structural movement, or misuse of the installed materials.
Materials and products are subject to the manufacturer warranties provided with those products. We do not extend any additional warranty beyond what is provided in the written service agreement.
THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE MAKE NO WARRANTY THAT THE SITE WILL BE AVAILABLE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
To the fullest extent permitted by law, Las Cruces Insulation and its owners, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of this Site or from any services provided, even if advised of the possibility of such damages.
Our total liability to you for any claim arising from services performed shall not exceed the total amount you paid for the specific service giving rise to the claim. This limitation does not apply to damages caused by our gross negligence or intentional misconduct.
All content on this Site, including text, images, logos, and design, is the property of Las Cruces Insulation or its content providers and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this Site without our prior written permission.

If informal resolution is not possible, any dispute arising from these Terms or from services provided by Las Cruces Insulation shall be resolved through binding arbitration conducted in Dona Ana County, New Mexico, in accordance with the rules of the American Arbitration Association. Each party shall bear its own costs unless the arbitrator awards otherwise. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
These Terms and Conditions are governed by the laws of the State of New Mexico, without regard to its conflict of law provisions. Any legal action not subject to arbitration under Section 10 shall be brought in the state or federal courts located in Dona Ana County, New Mexico, and you consent to personal jurisdiction in those courts.
We reserve the right to update or modify these Terms and Conditions at any time. Changes will be effective upon posting to this page with an updated effective date. Your continued use of this Site or engagement of our services after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
